Booking complete?
When concluding a distance contract by electronic means, should the words appearing on the order button or all elements of the online ordering process be strictly considered? Specifically, does the wording "booking complete” equate to the terms "order with obligation to pay”?
A recent decision by the CJEU answers these questions, stressing the importance of how traders should provide relevant information for the conclusion of contracts via websites. In addition, it is reconfirmed that, in any case, the button used to place the order on the site must be clearly labeled in a manner that provides an unequivocal message about the obligation to pay the price.
