Yolanda Beșleagă – article in the Romanian Journal of Private Law

In the Romanian Journal of Private Law (RRDP) No. 4/2025 – an issue published in March 2026 – with the theme "Forfeiture in the Civil Code and the Code of Civil Procedure," Yolanda Beșleagă - Managing Associate - published the article "On the performance bond provided by the economic operator declared the winner in the public procurement procedure."

The article analyzes the legal regime of the performance bond established following the signing of the public procurement contract by the successful bidder, with a particular focus on the legal relationship between the latter and the contracting authority.

Based on the specific legal regulations and the guidelines of the National Agency for Public Procurement, a series of practical aspects will also be highlighted to assist economic operators in understanding their rights and obligations, as well as the implications of contractual non-performance or defective performance from the perspective of the established guarantee.
