The legal regime of a guarantee established on a trade secret

Maria-Irina Crivăț – Associate – analyzes in a recent article published in Revista română de drept privat (RRDP) no. 3/2025 – published in January 2026 by Editura Universul Juridic – the nature of trade secrets and the extent to which they could be subject to a guarantee. At the same time, the paper compares this hypothesis with the situation of a guarantee on a patent. Finally, an alternative to the legal concept of a guarantee is sought with regard to trade secrets.
