Lawyer from STOICA & ASOCIAȚII – interview for Hotnews.ro about the legal perspective of Romania's accession to the Schengen area

Our colleague, Cosmin Pintilie - Senior Associate, STOICA & ASOCIAȚII -, discussed some current topics in a HotNews.ro interview.

Analyzing from a legal perspective the process of Romania's accession to the Schengen area, Cosmin presented the challenges that the Schengen mechanism currently faces, including from the perspective of the recent jurisprudence of the Court of Justice of the European Union. Our colleague's proposal is to interpret the disappointment in the public space regarding Austria's veto as proof of Romanians' attachment to the European integration process. And this extensive process of European integration can also generate some tensions between the major judicial actors, in the interview the topic of the relationship between the Court of Justice of the European Union and the Constitutional Court of Romania was also addressed, a subject that has all the chances to return to the foreground in the year 2023.

Finally, Cosmin emphasized that the effectiveness of the European legal construction depends to a very important extent on the way in which citizens and organizations understand how to try to benefit from the provisions of EU law, as well as on the responsiveness of national courts to the concrete exploitation of EU law.
