About the scope of the right of preemption

Through its recent jurisprudence (Decision no. 58/2022 published on November 21, 2022, in the Official Gazette) the High Court of Cassation and Justice (Complete for resolving legal issues) established that, in the situation of conventions for the alienation of possession on agricultural land located outside the city limits, it is not necessary to observe the right of pre-emption provided by art. 4 (1) of Law no. 17/2014.
