About the power of representation

The power of representation must be understood from the perspective of the category of legal prerogatives to which it belong the special powers.

In order to highlight the specifics of the power of representation, some clarifications are needed on the change of meaning of the term "power" in the context of constitutional democracy and the notion of "special power" in private law, the correlation between special powers and obligations, the difference between misuse and abuse of power, the exercise of special powers and the difference between them and the optional rights, as well as the situations in which there is representation without power and power without representation.
