The Romanian Private Law Magazine and the publishing house „Universul juridic” granted to Mr Radu Rizoiu, Senior Partner, the Octavian Căpăţână Award for the article "Applying the European Convention on Human Rights to the security interests in personal property" published in the Romanian Private Law Magazine no 5/2008. The second edition of Who’s Who in Business Romania 2009 – The most important business people in Romania - presents 1000 top managers and entrepreneurs covering 22 fields of activities. Mrs Cristiana Irinel Stoica, Founding Partner of STOICA & Asociatii, was nominated under the section “Professional Services” of Who’s Who in Business Romania 2009 published by Financial Newspaper (Ziarul Financiar).

Between 27-31 October 2009, Seville, the capital of Andalusia, will be hosting the 53rd edition of the annual UIA Congress, the organization’s biggest event which will bring together well reputed lawyers from all over the world.

STOICA & Asociatii, a member of International Association Lawyers (UIA), will be represented at the Congress by Mrs Cristiana I. STOICA, Founding Partner of the law firm, who will present the report “The Insurance and its Role in Financial Operations under the Romanian Law” in the Insurance Law Commission presided by Mrs Francoise Hecquet.

STOICA & Asociaţii, Attorneys at Law, is a member of World Link for Law since 2004, which is one of the largest international law networks in the world. Annually the members of World Link for Law meet for a conference held in one of the countries in which the association is represented by its members. This year is the turn of Argentina to host this conference in its capital city Buenos Aires, in October.

STOICA & Asociatii will be represented by Mrs. Cristiana I. STOICA and Mr. Valeriu STOICA, Founding Partners of the law firm.

In the last 2 editions, STOICA & Asociatii granted the award for the entire legal carrier and the award for artistic creation.

In 2007, the award for the entire legal carrier was granted to Mr Serban Beligradeanu, Ph.D. in Law, while in 2008, the award was granted to Professor Doctor Docent Vladimir Hanga.

This year, the award for the entire legal carrier will be granted to Mr Ion Bacanu, well-known lawyer with a major contribution to the set up of the international arbitration in Romania (motivation letter).

The award for artistic creation was granted in 2007 to Mrs Maria Rotaru, popular music artist, while in 2008 the award was granted to Andrei Ciubotaru, painting artist.

This year, the award for artistic creation will be granted to the opera artist Marius Manea with the aim to support his future artistic projects.

Finmedia published the third edition of “Top Lawyers” which makes an analysis of the law market pointing out the expertise gained over the years by lawyers who are already excellent practitioners. The analyzed fields of expertise were the ones which contributed most to the market development.

WallStreet, an online business journal, published a DealWatch report of top ten legal advisers by deal value in the first six months of 2009, ranking the most active legal advisers in mergers and acquisition market.

According to this top, STOICA & Asociaţii law firm, held by Valeriu Stoica, has advised two deals worth $293 mln, thus coming in at third in the ranking of top ten legal advisers by deal value as listed by DealWatch.

On September 5th at 20:00, more than 100 young Romanians performed Stravinsky's Firebird at the National Theatre in Bucharest as part of the George Enescu Festival.

This dance performance was an initiative of the Association „Jungen Rumänen eine Chance!“, a charitable trust founded by Monique Gruber, wife of former Ambassador of Germany in Romania and introduced a new artistic and social concept into our country: Community dance. Under the guidance of the renowned British choreographer Royston Maldoom and Joseph Eder of Germany, it was the first community dance project staged in Romania. The Bucharest performance of Firebird followed in the successful footsteps of similar performances in Berlin, New York, London and Luxembourg.

The young artists were aged between 11 to 22. Many were underprivileged and had experienced the hardships of living on the streets. Others had special needs. Yet together they had joined the intensive month long preparation to stage Firebird with great enthusiasm.

This unique performance of Firebird in Bucharest was a memorable event!

Chambers Europe offered to publicity its annual top ten domains of practice in Romania.

For each domain, the law firms are classified in categories (band) from 1 to 5, 1 being the highest category. For 2008, STOICA & Asociatii is ranked under category 1 for Intellectual Property and Dispute Resolution, and under category 3 for Competition/Antitrust.

The top takes into consideration also lawyers individually, the ranking system being the same. The lawyers of STOICA & Asociaţii distinguished in this top are:

Valeriu Stoica, nominated under category 1 for Dispute Resolution. According to Chambers Europe, Valeriu Stoica "remains a dominating figure in litigation, the international clients benefiting from his procedural knowledge and his splendid oratory skills "

The April number of the legal revue “Curierul Judiciar” was published. The "“Newsletter" rubric of this number, drafted by the STOICA & Asociaţii team, presents briefly the decision issued by the European Court for Human Rigths on January 13, 2009 in the case Faimblat vs. Romania, through which it was decided that the procedural mechanism regulated by the Law no. 10/2001 regarding the legal regime of certain real estates abusively taken over by the communist regime in the period March 6, 1945 – December 22, 1989 represents an interference in the right to file claims in front of a court of law, interference which cannot be considered proportional to the purpose had in consideration and which infringes the provisions of art. 6, para. 1 of the European Convention regarding the Human Rights. The Article clarifies the reasoning followed by the Strasbourg Court, as well as the analyze made by this Court as regards the efficacy of the reparation system established by Law no. 10/2001. The Financial Newspaper (Ziarul Financiar) edited in April 2009 TOP Transactions containing the main transactions in 2008-2009. STOICA & Asociatii was nominated in TOP Transactions with Affichage România acquisition of 3 companies from Multirekam portfolio (Efect Media, Outdoor Media and Communications Media), as well as with Saudi Oger ( Saudi Arabia) acquisition of 50% of Telemobil (Zapp).

The Article “The Constitutional Court’s Decisions No 1351/2008 and No 56/2009”

The February issue of the law magazine  ”Curierul Judiciar” marks the debute of  the permanent heading “Newsletter”signed by  the team of  “STOICA & Asociatii”. This month’s heading makes a short presentation of Decision No 1351/2008 and Decision No 56/2009 elaborated by the Constitutional Court of Romania and through which the constitutionality of the Law on modification and completion of Law  No 10/2001 is established; the Court thus repels as groundless the arguments exhibited in the two intimations for non constitutionality, intimations expressed by a number of 55 Deputies, and respectively, by the President of Romania. The article generally comments on the Decisions of the Constitutional Court and it is signed by two assistant lawyers: Alexandru Vartej and Bogdan Popescu.

Everybody is concerned by the present financial crisis. Especially due to its globalization. The questions come from all sides: how long will take this crisis? Are there going to be found solutions for the removal or at least diminish of its effects? Did by any chance the capitalism proved to be insecure? What Hill it happen to the markets destined to exports? Are the emerging markets affected by the crisis and in which measure? Is the globalization a solution which deserves the thought? Which are the models to follow, if such models exist, so that the life does not take us by surprise as it did with this recent global financial-banking crisis?

These are normal questions which will be answered by the International Chamber of Commerce, which is celebrating 90 years from its setting up, as world enterprises organization, through Guy Sebban, its General Secretary, on the occasion of the launch of the action plan of ICC for 2009 (read)

Preoccupied by the global situation of the financial institutions, we find less time for those events related really to our existence. The death of a colleague affects us deeply especially when this occurs in direct relation to his profession. It is even sadder, not only for the disappeared person, but also for his family, and for the entire professional body, to see that the efforts for the protection of the right to life itself end by the death of the fighter. The lawyers are, or should be, by their nature, real fighters. Some of them, very few, become heroes. This is the case of Stanislav Markelov, lawyer known as fighter for the protection of the human rights (he defended the families of the victims of the bloody Chechen intervention in the Moscow, or various Russian journalists), who was killed on January 19, 2009, in Moscow. The International Lawyers Union, the oldest international lawyers association, published recently a press release regarding the sad event (read). Incipient forms of the lawyer profession existed since long time in the Romanian States. The recognition and regulation, since the Fanariot era, of the right to defense in front of the judges, the expression of the “most absolute and abstract judicial liberalism”, as Alexandru Herlea in his work “Law History Studies”, evoluated with the evolution of the judicial systems.

The most important capital in the construction of a law firm is the reputation. But, the reputation is made, it is not simply had. To make a good reputation is a long term investment in the lawyer profession … Once acquired, the good reputation must be kept and consolidated during the time.
